To

His Excellency Governor of Tamilnad Rosiah ,

Respected His Exxcellency,

Sub: Tribal communities – Arbitrary action of bureaucrats regarding Inclusion and           

         Exclusion of casts against the Presidential Notification – Pray intervention and

         render justice.

The following is the humble submission before His Excellency, the Governor of Tamilnadu for rendering justice in the light of the powers conferred on constitutionally.

His Excellency would aware that there have been wide spread commotion and media reports in connection with the Inclusion and Exclusion of castes under the categories of Scheduled Tribe, particularly in Tamilnadu. The recent ugly incidence that took place at Tiruvannamali Kurumba and Kurumba Gounder coming under Most Backward Class peoples are demanding caste certificate as KURUMANS Scheduled Tribe  by an unethical groups is the worth example.

What is astonishing is that almost all the political parties including ruling party and NGOs are being behind these episodes with the sole aim of garnering- Vote Banks. These are  obviously for the reasons that the tribal communities  alone is utterly in lack of its either political leader or political powers. The present NDA government is also badly felt of it.

 The constitutions enacted exclusively to protect the interest of the tribal communities are also of no avail, as far as Tamilnadu is concerned. Moreover, the continued apathy of the Governors towards the tribal communities is the main reason for the untoward elements taking the law into their hands in as much as to bend the local administrations in their favor.

 To our great dismay, that some of the administrations also succumbed to the pressure of the unethical groups being backed by the politicians and NGOs patronizing some bureaucrats and got certificates issued clandestinely. The incidence that have been taken place at Vellore district where 16 certificates at the coerce attitude  of court of law has been issued without any merits. These are all coupled to have been enthused others to gain the tribal status in troubled water.

It is our humble prayer before His Excellency, the Governor of Tamilnadu kindly look into these mischievous and directs the State Government of Tamilnadu to take action on the bureaucrats who are the route cause for all these myths which is causing worry of innocent and marginalized tribal’s who are still far flung from the main stream of other societies.

 If the State Government is really interested in the welfare of the tribal’s, let it first acts on the report of Advisory Committee, Department of Social Security, Govt.of India , constituted in June,1965 which has recommended nearly 29 casts patently having NIL population in the census reports of 1961 warranting  exclusion from the Presidential Gazette Notification Scheduled Tribe  of Tamilnadu. When all other Governments had been acted swiftly  we couldn’t understand as to why the Tamilnadu government alone is still showing its reluctance even after lapses of 49 years .

It is therefore humbly requested  His Excellency the Governor of Tamilnadu to constitute a Tribal Advisory Council in consonance of 5^th Schedule of the constitution which would not only acts as wise consul to His Excellency the Governor of Tamilnadu but also undo the injustice done to the tribal communities so far.

We do hope His Excellency the Governor of Tamil  would positively respond to our prayer  in line.

Sub: Tribal Community – Prevent spurious struggle in the name of Tribal’s

Our Hon’ble Puratchithalavi Amma would aware that among all the communities in Tamilnadu, the only community, tribal community is calm in nature, peaceful and secluded in all respect in spite of facing all odds and hurdles in their day to day life. They never dream of resorting any struggle obviously for the reasons that they are far from the main stream of the civilized societies. It is their conviction that doing harm to others is SIN and therefore by hereditary accustomed themselves to the life of restraining and scarification to others whosoever it may be. These are the unique qualities for better judgment as to identify of their richness in their distinctive culture and shyness of contact with community at large. Their primitiveness still remains unaltered, nor are they conscious of the fruit of reservation set apart them being enjoyed by others in their names.

Now there have been incidents of violations and continued struggles by the spurious tribal’s everywhere in Tamilnadu particularly by the people proximate to the civilized regions. The core point of their struggle is only to get the certificate and none else, whereas the problems of real and genuine tribal’s are not limited to the community certificates alone, but also numerous problems are there being encountered in their day to day walks of their life. The silence of the Director, Tribal Research Institute, M.Palada  , Ootty in this crucial situations would be evident enough to prove that all these struggles are political biased with the affinity of NGOs which are being patronized by the retired IAS Officers especially from the Adi Dravidar department.

According to the directions of the Home Ministry of India, New Delhi OM BC 12025/2/76-SCT (I) dt.22.3.1977, issuance of the community certificates is the prerogative of the Revenue authorities who are being guided by the Revenue Records prior to the Presidential notification i.e.1956, keeping in view of the fact that agriculture is the only source of livelihood for Scheduled Tribes, apart from collection and sale of minor forest produce to complement their income. Land is their most important natural and valuable assets and imperishable endowment from which the tribal’s derive their sustenance, social status, economic and social equality, Permanent place of the abode and work and living. Therefore, the tribal’s have great emotional attachment to their lands which are potent weapon of economic empowerment in social democracy. Thus, no substitutes other than the land records will be the criteria for issuing community certificates.

The following verdicts of the court of law are also to be viewed as guiding principles.

W.P. 11933 0f 1983 and 3238 of 1984 in the case of Karibeeran Vs State of Tamilnadu

W.P. 20277 of 2011 in the case of P.Vinoth Vs Sub- Collector of Ranipet.

These are only examples and not exhaustive.

It is therefore humbly requested our Hon’ble Chief Minister Purtchithalavi Amma kindly order thro’ the vigilance wing to find out as to who are the black sheep behind these struggles which are considered to be embracing not only to the honest officers under the helm of your efficient administration but also the genuine and pious community of the tribal’s. More over the survey into the intra- community breakup of the tribal’s reveal that majority of those fraudulently enjoy the reservation benefits are from the forward and backward communities officially masquerading themselves as Kondareddy, Kattunayakan, Kurumans, classified as Scheduled Tribe.
